Introduction

Welcome to Fine Touch Group Pty Ltd ("Fine Touch Group," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website and renovation services. By accessing our website or engaging our services, you agree to be bound by these Terms.

Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you should not use our website or services.

Services

Fine Touch Group provides apartment renovation services in Sydney, including but not limited to:

  • Complete apartment renovations
  • Kitchen renovations
  • Bathroom renovations
  • Small renovations and updates
  • Strata approval management
  • Design consultation

The specific services to be provided will be detailed in a written quote and contract between Fine Touch Group and the client.

Quotes and Contracts

All quotes provided by Fine Touch Group are:

  • Valid for 30 days from the date of issue, unless otherwise specified
  • Based on the information provided by the client and visual inspection of the property
  • Subject to change if the scope of work changes or if unforeseen circumstances arise

A binding contract is formed when the client accepts our quote in writing and pays the required deposit. The contract will include:

  • Detailed scope of work
  • Project timeline
  • Payment schedule
  • Material specifications
  • Any specific terms or conditions

Payment Terms

Our standard payment schedule is as follows:

  • 20% deposit upon signing the contract
  • 30% payment at commencement of work
  • 30% payment at mid-point of the project
  • 20% final payment upon completion and client satisfaction

Payment methods accepted include electronic bank transfer and credit card. All payments are due within 7 days of invoice date. Late payments may result in work stoppage and additional fees.

Variations and Changes

Any changes to the agreed scope of work must be:

  • Requested in writing by the client
  • Approved by Fine Touch Group
  • Documented in a variation order
  • Paid for in accordance with the variation terms

Fine Touch Group reserves the right to charge additional fees for variations that increase the scope of work or require additional materials or labor.

Strata Approvals

For renovations requiring Strata approval:

  • Fine Touch Group will assist in preparing and submitting the necessary documentation
  • The client is responsible for providing accurate information about their building's requirements
  • Fine Touch Group cannot guarantee Strata approval, though we have a 98% success rate
  • Delays in Strata approval may affect project timelines

Warranties

Fine Touch Group provides the following warranties:

  • 6-year structural warranty as required by NSW Fair Trading
  • 12-month workmanship warranty on all installation and labor
  • Manufacturer warranties on all fixtures, appliances, and materials (passed on to the client)

Warranty claims must be submitted in writing and are subject to inspection by Fine Touch Group. Warranties do not cover damage caused by:

  • Normal wear and tear
  • Improper use or maintenance
  • Alterations made by the client or third parties
  • Acts of nature or circumstances beyond our control

Client Responsibilities

The client is responsible for:

  • Providing accurate information about the property
  • Securing necessary permissions (e.g., Strata, council) with our assistance
  • Making timely decisions on materials and design elements
  • Providing reasonable access to the property during agreed hours
  • Making payments according to the agreed schedule
  • Promptly communicating any concerns or issues

Termination

Either party may terminate the contract under the following conditions:

  • By mutual agreement in writing
  • If the other party breaches a material term of the contract and fails to remedy the breach within 14 days
  • If Strata approval is not obtained after reasonable efforts

In the event of termination:

  • The client will pay for all work completed up to the termination date
  • Fine Touch Group will provide all relevant documentation and materials
  • Any deposit or advance payment may be partially refundable, depending on the circumstances

Liability Limitations

Fine Touch Group's liability is limited to:

  • The total contract value for direct damages
  • Compliance with all applicable laws and regulations
  • Maintaining appropriate insurance coverage

We are not liable for:

  • Indirect, consequential, or special damages
  • Delays caused by factors beyond our control
  • Pre-existing conditions not visible during initial inspection

Dispute Resolution

In the event of a dispute:

  • The parties will first attempt to resolve the issue through good-faith negotiation
  • If negotiation fails, the dispute may be referred to mediation
  • If mediation is unsuccessful, the dispute may be resolved through arbitration or legal proceedings

Intellectual Property

All designs, plans, and documents created by Fine Touch Group remain our intellectual property unless otherwise agreed in writing. We reserve the right to use photographs of completed projects for marketing purposes, with client consent.

Privacy

Fine Touch Group collects and uses client information in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after any changes indicates your acceptance of the modified Terms.

Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
